Federal Law

The U.S. federal law* defines Hemp as the following:

The Cannabis Sativa L. plant with no more than 0.3% THC concentration on a dry weight basis. This includes any part of that plant, including the seeds thereof and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not.

*Agriculture Improvement Act of 2018 ("Farm Bill")

State Law

In addition to the federal law, states in the U.S. have issued their own regulations or declarations regarding the sale, purchase, possession and consumption of hemp and CBD products. Certain states have no explicit law that either allows or prohibits the retail sales of such products. 

These laws, declarations and policy statements are separate and unrelated to any laws governing medical use of cannabis and other THC-containing products.
